Your trained supervisor or DER makes the determination. We provide the collector. An incident at two in the morning is a hard time to start looking for one, and the 24/7 Emergency Response Program settles that before it happens: clients who enroll have an after-hours response path already in place, so when your supervisor decides a post-accident or reasonable-suspicion test is required outside business hours, the collection is coordinated inside the windows the rule sets. Those windows are yours to meet: an alcohol test attempted within two hours, with attempts stopping and a record made at eight, and drug-test attempts stopping at thirty-two hours (49 CFR 382.303(d)). Under 49 CFR 40.355(g) a service agent may not make the decision to test for an employer; that decision belongs to a supervisor or company official trained under 49 CFR 382.603 (382.307(c)). This is a retained program you sign up for in advance, and the after-hours contact is issued privately to enrolled clients at enrollment.

Can I call for emergency testing if I'm not enrolled?
After-hours coordination is available to enrolled clients. This is coverage you set up in advance: enrolled clients have a response path and an after-hours contact in place before an incident, and that is what makes the response dependable.
Who decides whether a test is required?
You do. Under 49 CFR 382.303 and 382.307 the post-accident determination is the employer's and the reasonable-suspicion determination belongs to a supervisor or company official trained under 382.603, and 49 CFR 40.355 bars a service agent from making either decision for an employer. PSI coordinates the collector once you have decided. Owner-operators are the one exception, where the rule lets a C/TPA make those decisions.
Why is this a retained program?
